Chapter 96

א <big><strong>מתני׳</strong></big> לא ישב בצילה ואם ישב טהור ולא יעבור תחתיה ואם עבר טמא היתה גוזלת את הרבים ועבר תחתיה טהור:
1 One may not sit in its shadow, but if he sat he is pure. Nor may he pass beneath it, and if he passed he is impure.
ב <big><strong>גמ׳</strong></big> לא ישב בצילה פשיטא אמר רבה בר בר חנה א"ר יוחנן לא נצרכא אלא לצל צילה
2 GEMARA. One may not sit in its shade. This is obvious! Rabbah b. Bar Hanah said in the name of R. Yohanan: It was only necessary to mention it in the case of the shade of its shade.
ג מכלל דבצל קומתה אם ישב טמא לא דאפי' לצל קומתה נמי אם ישב טהור והא קמ"ל דאפילו לצל צילה לא ישב
3 By inference if he sat in the shade corresponding to the height of the tree he is defiled? No, even if he sat in the shade corresponding to the height of the tree he is also pure, and it teaches us that he may not sit even in the shade of its shade.
ד איכא דמתני לה אסיפא ואם ישב טהור פשיטא אמר רבה בר בר חנה א"ר יוחנן לא נצרכא אלא לצל קומתה מכלל דלצל צילה אפילו לכתחלה ישב לא הא קמ"ל דאפילו לצל קומתה אם ישב טהור:
4 There are some who apply this teaching to the end of the mishnah: But if he sat, he is pure. This is obvious! Rabbah b. Bar Hanah said in the name of R. Yohanan: It was only necessary to teach this in the case of the shade corresponding to the height of the tree. By inference he may sit in the shade of its shade even ab initio? No; rather it teaches us that even if he sat in the shade corresponding to the height of the tree he is pure.
ה ולא יעבור תחתיה ואם עבר טמא: מ"ט אי אפשר דליכא תקרובת עבודת כוכבים
5 Nor may he pass beneath it, and if he passed [beneath it] he is impure. What is the reason? Because it is impossible that there is not there [remains] of idolatrous sacrifices there.
ו מני רבי יהודה בן בתירא היא דתניא רבי יהודה בן בתירא אומר מנין לתקרובת עבודת כוכבים שמטמאה באהל שנאמר (תהלים קו, כח) ויצמדו לבעל פעור ויאכלו זבחי מתים מה מת מטמא באהל אף תקרובת עבודת כוכבים מטמא באהל:
6 Whose teaching is this? It is that of R. Judah b. Batera; for it has been taught: R. Judah b. Batera says: How do I know that an idolatrous sacrifice defiles inside a tent? Because it is said, “They joined themselves also to Baal-Peor, and ate the sacrifices of the dead” (Psalms 106:28) just as a dead body defiles in a tent, so an idolatrous offering defiles in a tent.
ז היתה גוזלת את הרבים ועבר תחתיה טהור: איבעיא להו עבר או עובר רבי יצחק בן אלעזר משמיה דחזקיה אמר עובר ורבי יוחנן אמר אם עבר
7 If it encroaches upon the public road and he passed beneath it he is pure. They asked: [Is the word to be read] “passed” or “passes”? R. Yitzchak b. Elazar said in the name of Hezekiah: “Passes.” But R. Yohanan said: “Passed.”
ח ולא פליגי הא דאיכא דירכא אחרינא הא דליכא דירכא אחרינא
8 But they do not really dispute: The one who says [passed] refers to a case where there is another road, and the one who says [passes] to a case where there is not another road.
ט א"ל רב ששת לשמעיה כי מטית להתם ארהיטני היכי דמי אי דליכא דירכא אחרינא ל"ל ארהיטני מישרא שרי ואי דאיכא דירכא אחרינא כי אמר ארהיטני מי שרי
9 R. Sheshet said to his attendant, “When you reach there, run me past.” What was the case? If there was no other road, why does need he say, “Run me past,” since it is permitted? If, however, there was another road, when he said, “Run me past,” is that permissible?
י לעולם דליכא דירכא אחרינא ואדם חשוב שאני:
10 Certainly there was no other road; but with an important man it is different.
יא <big><strong>מתני׳</strong></big> זורעין תחתיה ירקות בימות הגשמים אבל לא בימות החמה והחזירין לא בימות החמ' ולא בימות הגשמים ר' יוסי אומר אף לא ירקות בימות הגשמים מפני שהנביה נושרת עליהן והוה להן לזבל:
11 They may sow vegetables beneath it in winter but not in summer, and lettuce neither in summer nor winter. Rabbi Yose says: even vegetables [may not be planted] in winter because the foliage falls upon them and becomes manure for them.
יב <big><strong>גמ׳</strong></big> למימרא דרבי יוסי סבר זה וזה גורם אסור ורבנן אמרי זה וזה גורם מותר
12 GEMARA. Is this to say that R. Yose holds that when both this and that cause it is prohibited and the rabbis hold that when both this and that cause it is permitted?
יג הא איפכא שמעינן להו דתנן רבי יוסי אומר שוחק וזורה לרוח או מטיל לים אמרו לו אף היא נעשה זבל ונאמר (דברים יג, יח) לא ידבק בידך מאומה מן החרם
13 But haven’t we heard them say the opposite, for we have learned: R. Yose says: He may grind [an idol] to dust and scatter it to the wind or throw it into the sea. They said to him: Even so it may then become manure, and it says, “And nothing that is proscribed should cleave to your hand” (Deuteronomy 13:18)!
יד קשיא דרבנן אדרבנן קשיא דר' יוסי אדרבי יוסי
14 The rabbis contradict themselves and R. Yose contradicts himself.
טו בשלמא דרבי יוסי אדרבי יוסי לא קשיא התם דקאזיל לאיבוד מתיר הכא דלא קאזיל לאיבוד אסור
15 R. Yose does not contradict himself. In that case since the man proceeds to destroy [the idol], [R. Yose] permits [the use of the dust as manure]; but in the case here [in our Mishnah], where he does not proceed to destroy [the idol], [the dust] is prohibited [as manure].
טז אלא דרבנן אדרבנן קשיא איפוך
16 But the rabbis contradict themselves! Reverse [the statements in our Mishnah].
יז ואיבעית אימא לא תיפוך דר' יוסי כדשנין דרבנן כדאמר רב מרי בריה דרב כהנא מה שמשביח בעור פוגם בבשר
17 Or if you wish I can say that there is no need to reverse the positions. R. Yose [is resolved] as we explained; and that of the rabbis [is resolved] as R. Mari the son of R. Kahana said: What makes the hide valuable decreases the value of the meat.
יח הכא נמי מה שמשביח בנביה פוגם בצל
18 Similarly here, the benefit gained through the foliage is lost by the shade.
יט וסבר רבי יוסי זה וזה גורם אסור והתניא רבי יוסי אומר נוטעין יחור של ערלה ואין נוטעין אגוז של ערלה מפני שהוא פרי ואמר רב יהודה אמר רב מודה רבי יוסי שאם נטע והבריך והרכיב מותר
19 Does R. Yose really hold that in cases of “this one and that one causes” the product is prohibited? Have we not learned: R. Yose says: One may plant a young shoot which is orlah but not a nut which is orlah because it is fruit. And Rav Judah said in the name of Rav: R. Yose agrees that if one planted [a nut which is orlah] or bent it under the ground or grafted [a young shoot which is orlah on an old tree], [the fruit it grows] is permitted!
כ ותניא נמי הכי מודה רבי יוסי
20 It has been similarly taught R. Yose agrees
